Trade Prohibition list AS A RISK MANAGEMENT

BUYER BEWARE

Measures such as prohibitions, export licenses and restrictions assist in risk management and the regulation of trade in controlled and sensitive goods. They are established pursuant to international agreements and conventions on protecting people and the environment, on controlling drugs and harmful substances, and on contributing to international peace and weapons controls. This publication explores how particular international agreements and conventions operate in practice and how they link to the multilateral trading system.

The ECOWAS (Economic Community of West African States) Trade Prohibition List primarily focuses on items restricted from import into member states, with a secondary list of items prohibited from export. These restrictions aim to protect local industries, ensure food security, and address health and safety concerns.

Import Prohibitions:

• Nigeria's list (a key ECOWAS member) includes items like: Live or dead birds (including poultry), pork, beef, bird's eggs (excluding hatching eggs), refined vegetable oils and fats, sugar, certain medications (like paracetamol, chloroquine), and more.

• General Import Restrictions: Counterfeit goods, indecent or obscene materials, weapons, and certain hazardous materials are also commonly prohibited.

• Specific examples from Nigeria: Mosquito repellant coils, clotrimazole cream, cotrimoxazole tablets and syrups, fruit juice in retail packs, and magnesium trisilicate tablets and suspensions.

Export Prohibitions:

• Focus on Raw Materials and Natural Resources: Nigeria's list prohibits the export of maize, timber, raw hides and skin (including wet blue and all unfinished leather), scrap metals, unprocessed rubber latex and rubber lumps, and certain artifacts and antiquities.

• Protection of Endangered Species: Wildlife animals classified as endangered species and their products are also prohibited from export.

European Union Prohibition list

The European Union maintains a list of goods that are prohibited or restricted from import and export. These restrictions can be in place for various reasons, including trade policies, security concerns, public health, and international agreements.

Prohibited Goods:

• Certain Food Products: Import of meat and dairy products from non-EU countries is generally prohibited, with limited exceptions for certain fruits, vegetables, eggs, egg products, and honey.

• Specific Agricultural Products: Certain plant protection products, fishing tackle, and some types of electronic fishing systems are prohibited.

• Hazardous Materials: Radioactive materials, explosives, and certain chemicals are prohibited.

• Cultural Objects: Import of stolen Ukrainian cultural heritage items is prohibited.

• Luxury Goods: Some luxury goods, such as certain vehicles, are subject to export bans.

• Certain Industrial Goods: Some industrial goods with military significance, like certain minerals, chemicals, steel, and glass materials, may be restricted.

• Firearms and Ammunition: The export of firearms and ammunition to non-EU countries is restricted.

• Narcotic Drugs and Psychotropic Substances: These are prohibited for import and export.

• Goods violating intellectual property rights

Restricted Goods:

• Plant and Animal Products: Restrictions apply to the import of certain plants, animals, and products of animal origin, often requiring permits or certifications.

• Medicinal Products: Certain medicinal products, especially those requiring a prescription, may be subject to restrictions on import and export.

• Goods with Specific Regulations: Many goods are subject to specific regulations regarding labeling, packaging, or other requirements for import and export.

• Goods from Specific Countries: The EU may impose country-specific restrictions (embargos) on trade due to political or security concerns, ranging from partial to total bans on trade.

Reasons for Prohibitions and Restrictions:

• Public Health and Safety: To prevent the spread of diseases or protect consumers from harmful substances.

• Environmental Protection: To prevent the import of goods that negatively impact the environment.

• Security: To prevent the import or export of goods that could be used for harmful purposes.

• Trade Policy: To protect domestic industries or enforce international agreements.

Examples of Restrictions Related to Specific Countries:

• Sanctions Against Russia: The EU has imposed extensive sanctions against Russia following its invasion of Ukraine, including import and export bans on various goods.

• Country-Specific Embargos: The EU may impose embargoes on specific countries for various reasons, such as human rights violations or regional instability.

Additional Information:

• The EU's list of prohibited and restricted goods is complex and can change, according to the European Commission.

Prohibited and Restricted Imports

The following items are prohibited from entering China: arms, ammunition, and explosives of all kinds; counterfeit currencies and counterfeit negotiable securities; printed matter, magnetic media, films, or photographs that are deemed to be detrimental to the political, economic, cultural, and moral interests of China; lethal poisons; illicit drugs; disease-carrying animals and plants; foods, medicines, and other articles coming from disease-stricken areas; old/used garments; and local currency (RMB). Food items containing certain food colorings and additives deemed harmful to human health by the National Health and Family Planning Commission (NHFPC) are also barred.

In addition, China restricts or prohibits the importation of certain commodities related to the processing trade. The Catalogue of Commodities Which are Restricted or Prohibited from Importing for Use in the Processing Trade is designed to shift the direction of China’s processing trade toward handling commodities with higher technological content and greater value-added potential. The catalog identifies several types of “prohibited commodities”: used garments; used publications with licentious content; radioactive or harmful industrial waste; and junk and restricted commodities. This list was most recently revised in 2015.

United State Prohibition list

Prohibited and Restricted Items

CBP has been entrusted with enforcing hundreds of laws for 40 other government agencies, such as the U.S. Fish and Wildlife Service, the U.S. Department of Agriculture and the Centers for Disease Control and Prevention. These agencies require that unsafe items are not allowed to enter the United States. CBP officers are always at ports of entry and assume the responsibility of protecting America from all threats.

The products CBP prevent from entering the United States are those that would injure community health, public safety, American workers, children, or domestic plant and animal life, or those that would defeat our national interests. Sometimes the products that cause injury, or have the potential to do so, may seem fairly innocent. But, as you will see from the material that follows, appearances can be deceiving.

Before you leave for your trip abroad, you might want to talk to CBP about the items you plan to bring back to be sure they're not prohibited or restricted. Prohibited means the item is forbidden by law to enter the United States. Examples of prohibited items are dangerous toys, cars that don't protect their occupants in a crash, bush meat, or illegal substances like absinthe and Rohypnol. Restricted means that special licenses or permits are required from a federal agency before the item is allowed to enter the United States. Examples of restricted items include firearms, certain fruits and vegetables, animal products, animal by products, and some animals.
